A California district lawyer declined to file charges Tuesday towards former heavyweight boxing champion Mike Tyson after he was recorded on video in a physical altercation with another passenger on a JetBlue flight.

San Mateo County District Attorney Steve Wagstaffe made the decision after having reviewed police stories and videos of the April 20 incident. Both the passenger, who has not been identified, and Tyson requested that no expenses be filed.

"Yesterday afternoon the San Mateo County District Lawyer’s Office concluded its evaluate of the case involving Mike Tyson on the San Francisco Airport on April 20, 2022 and the allegation that he committed a misdemeanor battery in opposition to one other passenger on an airplane while waiting at the terminal prior to departure," Wagstaffe stated in a statement.

"Our determination is that we will not file any costs in opposition to Mr. Tyson based on the circumstances surrounding the confrontation. These embody the conduct of the victim leading as much as the incident, the interplay between Mr. Tyson and the sufferer, as well as the requests of both the sufferer and Mr. Tyson that no fees be filed in this case," Wagstaffe said.

The case is now closed.

Cellphone video showed Tyson, 55, appearing to attempt to punch someone who was pushing him away. Representatives for Tyson mentioned the particular person was harassing Tyson. The video didn't present what occurred before the altercation.

David Chesnoff, Richard Schonfeld and Martin Sabelli, attorneys for Tyson, responded to the choice to not file fees by thanking Wagstaffe, the San Mateo County sheriff and regulation enforcement businesses "for their cautious, diligent, and professional work."
