DALLAS - The high court docket will permit a wrongful loss of life lawsuit to proceed in opposition to town of Dallas and 4 law enforcement officials.
The family of a man who died in police custody in 2016 sued.
Tony Timpa called police for assist as he had a drug and mental well being disaster.

The town of Dallas argued the officers are legally protected against lawsuits.
The Supreme Court upheld a federal appeals court’s ruling that will allow the case to proceed.

"The choice signifies that the case can proceed to trial and that there shall be no more delays from any appellate court. Also, the choice signifies that the Fifth Circuit did it right that their ruling relating to deadly force would be the regulation of the land at the least in Mississippi, Texas and Louisiana for as long as we all know," stated Geoff Henley, an attorney for Timpa’s family.
These are the states coated by the Fifth Circuit Court of Appeals ruling allowing the swimsuit to continue.
Three years in the past, the Dallas district attorney dropped legal charges towards three of the officers.
