Supreme Court says wrongful demise lawsuit towards Dallas officers can go ahead

DALLAS - The excessive court docket will enable a wrongful dying lawsuit to proceed against the city of Dallas and four police officers.

The family of a man who died in police custody in 2016 sued.

Tony Timpa known as police for help as he had a drug and mental well being crisis.

The city fought against releasing physique digital camera video and whit it did come out it was obvious why. It showed the officers mocking the dying man.

One had his knee on Timpa’s back and neck for nearly quarter-hour and the health worker said that contributed to his death.

The city of Dallas argued the officers are legally shielded from lawsuits.

The Supreme Court upheld a federal appeals court docket’s ruling that can permit the case to proceed.

"The choice means that the case can proceed to trial and that there shall be no extra delays from any appellate court docket. Additionally, the choice implies that the Fifth Circuit did it right that their ruling concerning deadly pressure would be the legislation of the land no less than in Mississippi, Texas and Louisiana for as long as we all know," stated Geoff Henley, an lawyer for Timpa’s family.

These are the states coated by the Fifth Circuit Court docket of Appeals ruling allowing the swimsuit to continue.

Three years in the past, the Dallas district attorney dropped criminal expenses against three of the officers.
